Terms and Conditions
1. General
By-Nena is based in Berkel en Rodenrijs, Chamber of Commerce number: 93068190. Customer: The party with whom By-Nena has entered into an agreement.
2. Applicability
These terms and conditions apply to all offers, activities, orders, agreements, and deliveries of services or products by or on behalf of By-Nena. Deviations from these conditions can only be made in writing. Additional and/or deviating terms of the customer or third parties are explicitly excluded.
3. Prices
All prices used by By-Nena are in euros, including VAT and administration costs, but excluding shipping or export costs. By-Nena is entitled to adjust prices at any time. Increases in the cost price of products or parts thereof, which By-Nena could not foresee at the time of the offer or agreement, may lead to price increases. The customer has the right to dissolve the agreement in case of a price increase, unless this is due to statutory regulations.
4. Payments
Products must be paid for immediately via our website.
5. Return costs reimbursement
If the customer exercises their right of withdrawal and returns the entire order on time, the costs for returning the complete order are the responsibility of the customer.
6. Delivery
Delivery takes place while stocks last. All items are made to order.
7. Delivery term
Any delivery term specified by By-Nena is indicative and does not entitle the customer to dissolution or compensation if this term is exceeded. Delivery starts once the customer has completed the entire order process and received a confirmation of their order from By-Nena.
8. Transport costs
These costs are borne by the customer unless otherwise agreed.
9. Packaging and Shipping
If the packaging of a delivered product is opened or damaged, the customer must have the carrier or delivery person make a note before accepting the product. Without this note, By-Nena cannot be held liable for any damage. If the customer arranges the transport, they must report any visible damage to the products or packaging to By-Nena before transport; otherwise, By-Nena cannot be held liable for any damage.
10. Warranty
The warranty on products only applies to defects caused by faulty manufacturing, construction, or material. The warranty does not cover normal wear and tear, damage due to accidents, product modifications, negligence, or improper use by the customer, or when the defect’s cause cannot be determined. The risk of loss, damage, or theft of products that are the subject of an agreement between parties passes to the customer when these products are legally and/or actually delivered, or when they come into the control of the customer or a third party receiving the product on behalf of the customer.
11. Exchanges
Exchanges are only possible if the following conditions are met: Exchange must take place within 14 days of shipment, provided the product is returned in its original packaging. See return policy.
